It is instructive to posit that customary courts promote cultural values, uphold and preserve customs and traditions of communities through appropriate adjudication on issues of culture and traditions brought before them. The court also promotes cultural identity and social cohesion in Imo State and provides a framework for resolving disputes in line with local norms and practices.
It is imperative to state that customary courts equally offer an affordable and efficient means of resolving disputes, especially for rural communities. They provide an alternative to formal courts, which can be intimidating and costly.
In land dispute resolution,
customary courts play a significant role in resolving land disputes – a common issue in Imo State. They apply customary law to determine ownership and usage rights, thereby promoting peace and stability in the various communities in Imo State.
As regards marriage and family matters,customary courts handle matters relating to marriage, divorce, and inheritance. The court applies customary law to protect the rights of all parties involved.
Its justice system is also community-based. It is an incontestable fact that
customary courts are community-based, with its presiding chairman and officials well grounded or familiar with local customs and practices. This ensures that justice is delivered in a culturally sensitive manner.
In spite of its essence in the justice delivery system, especially as it affects the communities, customary courts are still faced with challenges and limitations. These include limited resources, inadequate training for officials of the court,and potential biases. Addressing these issues,however, can enhance their effectiveness.
Nigerian Horn is of the view that strengthening customary courts in
Imo State can guarantee expeditiously and more reliable justice delivery in the communities.The government can do this by providing adequate funding, training for court officials, and upgrading the infrastructure or facilities in the courts.
It is also advisable that customary courts collaborate with formal courts to ensure consistency and coherence in the application of law. This can promote a more integrated justice system.
There is no point reemphasizing that as a vital institution,
customary courts promote cultural values, enhance accessible justice, and contribute to community-based dispute resolution. Strengthening them,therefore, can enhance justice delivery and social cohesion.
