The attention of the Management of the Federal University of Technology, Owerri (FUTO), established under the Federal Universities of Technology Act, Cap F23, Laws of the Federation of Nigeria 2004, has been drawn to a recent purported directive arising from the activities of an Inter-Ministerial Committee suggesting excision of FUTO’s permanent site.
The University states categorically that such purported directives are illegal, inconsistent with judicial pronouncements and presidential authority, and of no effect whatsoever.
For the avoidance of doubt:
- FUTO, as a legal personality and agency of the Federal Government of Nigeria, is the lawful holder of the Right of Occupancy over its permanent site, covering 4,455.76 hectares as clearly delineated on Imo State of Nigeria Plan No. OWR(M) 321, Tracing No. (CARTO) IM 720, commencing from concrete pillar MB 10967.
- The ownership of this land has been reaffirmed by binding judicial pronouncements.
- FUTO has neither ceded nor excised any part of its land to individuals, groups, or entities. Any contrary claim or purported directive is false and unlawful and void.
- By the provisions of Section 19 of the Federal Universities of Technology Act, no University land may be disposed of or charged without the prior written consent of the President of the Federal Republic of Nigeria. No such consent has been obtained.
- Members of the public are strongly advised to resist and reject any pressure, inducement, or invitation to procure, acquire, hold, or otherwise deal in FUTO land. Any such transaction is invalid and undertaken entirely at the risk of the parties involved.
- For confirmation of the extent and boundaries of the University’s permanent site, the public is advised to contact the Director, Physical Planning and Development Unit, Federal University of Technology, Owerri.
The Management of FUTO will not hesitate to take every lawful step, including legal enforcement, against any person or group attempting to encroach upon, or unlawfully interfere with the University land.
